Terms of Use

1. Acceptance of Terms

By accessing or using the ToldYa platform at toldya.xyz (the "Site"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Site.

2. Description of Service

ToldYa is a cryptographic prediction commitment platform deployed on the Solana blockchain. Users create sealed predictions (commitments), reveal them later, and build a credibility track record. The Site provides a web interface to interact with the on-chain smart contracts. Palominito Technologies does not custody funds.

3. Eligibility

You must be of legal age in your jurisdiction to use the Site. You are responsible for ensuring that your use of the Site complies with all laws and regulations applicable to you. Access from restricted jurisdictions is prohibited (see Section 4).

4. Restricted Jurisdictions

The Site and protocol are not available to persons or entities located in, incorporated in, or residents of any of the following jurisdictions. By using the Site you represent and warrant that you are not located in, incorporated in, or a resident of any restricted jurisdiction.

OFAC-Sanctioned Jurisdictions

Cuba, Iran, North Korea, Syria, Russia, and Myanmar (Burma), including the Crimea, Donetsk, and Luhansk regions of Ukraine. Access from these jurisdictions is prohibited under U.S. Office of Foreign Assets Control (OFAC) regulations and international sanctions frameworks.

Regulatory-Restricted Jurisdictions

The following jurisdictions prohibit or restrict access to prediction market or binary outcome financial products:

  • United States — CFTC jurisdiction over binary options and prediction markets
  • United Kingdom — FCA ban on retail binary options and crypto derivatives
  • Australia — ASIC ban on binary options to retail clients
  • Canada — CSA ban on binary options advertising and trading
  • Israel — Domestic ban on binary options

European Union / European Economic Area

All EU/EEA member states are restricted under ESMA regulations on retail binary options, including but not limited to: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, and Sweden.

This list may be updated at any time without prior notice. Attempting to circumvent geographic restrictions (e.g., through VPNs or proxies) is a violation of these Terms and may result in loss of access to the Site.

5. No Financial Advice

Nothing on the Site constitutes financial, investment, legal, or tax advice. Staking on predictions involves risk of loss. You should consult qualified professionals before making financial decisions. Past performance does not guarantee future results.

6. Risks

  • Smart contract risk: The protocol is deployed as on-chain code on Solana. While internally reviewed, smart contracts may contain bugs. The program has not undergone a formal third-party security audit.
  • Stake risk: You may lose your staked SOL if a counter-stake is resolved against your prediction.
  • Network risk: Solana network congestion or outages may prevent timely execution of transactions.
  • Commitment privacy: Sealed predictions are private, but once revealed, the content is permanently public and on-chain.

7. User Responsibilities

  • You are solely responsible for securing your wallet and private keys.
  • You are responsible for all transactions submitted from your wallet.
  • You will not use the Site for any unlawful purpose or to manipulate outcomes.
  • You understand that blockchain transactions are irreversible.
  • You are responsible for storing your prediction text and salt until you choose to reveal.

8. Intellectual Property

The ToldYa on-chain program source code is available under the Business Source License (BUSL-1.1). The Site interface, branding, and design are owned by Palominito Technologies. You may not reproduce, distribute, or create derivative works of the Site without permission.

9. Limitation of Liability

To the maximum extent permitted by law, Palominito Technologies and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or the protocol, including but not limited to loss of funds, data, or profits.

10. Disclaimer of Warranties

The Site and protocol are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Site after changes constitutes acceptance of the modified Terms.
